When Did the IRS Finalize the Rules?

This is where a lot of confusion comes from, because there are genuinely two different official dates in play:

  • April 10, 2026 The IRS issued its public announcement (IR-2026-49) that final regulations had been completed, along with Treasury Decision T.D. 10044. This is when the news broke.
  • April 13, 2026 The final regulations, titled "Occupations That Customarily and Regularly Received Tips; Definition of Qualified Tips," were formally published in the Federal Register.

How to Claim the No Tax on Tips Deduction

1. Check you qualify

You must work in an eligible tipped occupation (server, bartender, stylist, rideshare driver, etc.), have a valid SSN, and file jointly if married.

2. Report total income

Enter your wages plus tips on line 1a of Form 1040 (from Box 1 of your W-2 or your 1099-NEC).

3. Claim the deduction on Schedule 1-A

Enter your qualified tip income in Part II. You can deduct up to $25,000, but never more than you actually earned in tips. The deduction shrinks if your income is above $150,000 (single) or $300,000 (joint filers).

4. Enter the total on Form 1040, line 13b

This lowers your taxable income, whether you itemize or take the standard deduction.

This only reduces federal income tax you'll still pay Social Security and Medicare tax on tips. If you're in Florida, there's no state income tax anyway, so this deduction is pure upside for you.

Example: Earned $75,000 total with $30,000 in tips? You deduct the $25,000 cap. Earned $18,000 in tips? You deduct the full $18,000.

How Long Does the Deduction Last?

This is a temporary provision, not a permanent change to the tax code. It applies to taxable years beginning after December 31, 2024, and before January 1, 2029 covering tax years 2025 through 2028. Unless Congress extends it, tips earned in 2029 and beyond would return to being fully taxable with no special deduction.

Do You Have to Wait Until 2026 to Benefit?

No. If you earned tips in 2025, you were already eligible to claim the deduction on the return you filed in early 2026 you didn't need to wait for the final regulations, the June 2026 effective date, or the new W-2 reporting system. You simply calculated your qualifying tip amount using your existing W-2 or 1099 tip figures.
